Holland Law Firm Reaches Settlement with Bayer in Roundup® Case

ST. LOUIS, MO – 06/24/2020 – Holland Law Firm is pleased to announce that it has reached a settlement with Bayer for its clients with claims related to use of Roundup®, a glyphosate-based herbicide originally produced by St. Louis-based Monsanto. According to firm president, Eric Holland, the settlement “is a great result, especially considering all of the risks going forward, risks like preemption and the unprecedented backlog of court cases as a result of COVID-19 and no civil jury trials for the foreseeable future.” According to Holland, both St. Louis City and County courts, where the vast majority of Roundup® cases are filed, are back to “Phase Zero” under the Missouri Supreme Court’s directives related state courts and COVID after employees tested positive in both courts.

“Bayer is doing the right thing with this settlement. The company is a huge part of St. Louis, its U.S. headquarters is up on Lindbergh Boulevard covering something like 100 acres with thousands of employees in the area. As a St. Louisan, I think Bayer did right as a corporate citizen.”

Holland Law Firm partner, Seth Crompton, also praised the settlement, saying “this resolution rightly brings this mass tort to a close. We understand that Bayer has also resolved cases with 100% of the other firms leading the litigation and virtually all cases with trial settings.”

Patrick Dowd, who helped lead the Roundup® litigation for the firm, echoed Holland and Crompton’s comments, noting that these cases face great uncertainty in court, including preemption, a legal defense that could wipe out any failure to warn claim. Dowd pointed out that “just this week, a federal court found California’s Proposition 65 cancer warning on Roundup® to be misleading and inaccurate.”
