But 3M/ Aearo breached its duty to those serving our country. 3M/Aearo knew design defects could cause the earplugs to loosen in the wearer’s ear while the service member incorrectly believes that the earplug is working as intended. Further, 3M/ Aearo knowingly used a rigged test to sell Dual-ended Combat Arms™ earplugs to the military. Finally, 3M/Aaero failed to warn service personnel of the significant and dangerous risks of the earplugs.
Earlier this year, on July 26, 2018, the United States Department of Justice announced that 3M/Aearo agreed to pay $9.1 million to resolve allegations that it knowingly sold the Dual-ended Combat Arms™ Earplugs to the United States military without disclosing defects that hampered the effectiveness of the hearing protection device.
